Incident

As Deputy Marshal Waymire and Deputy William Miller approached two men at a home to investigate a car theft, they were fired upon by one of the men. Marshal Waymire was struck in the abdomen, but both officers were able to return fire. The perpetrator fled on foot and the other surrendered.

Deputy Marshal Waymire was taken to a hospital where he died five days later.

The individual who fired the fatal shot committed suicide after a posse tracked him to a barn.
