On November 24, 1928, Officer Pogue, along with Officers Byron Curry, Rollas Neal and Bert Chambers, attempted to serve a search warrant on a "blind tiger" owned by Dewey Boshears. A blind tiger was the name given to places that sold illegal alcohol during prohibition.
Mr. Boshears operated a lunch stand on Grimes Lane next to his home. Officers Curry and Chambers went to the lunch stand to try and find Boshears and Pogue and Neal went to Boshears' home. Boshears was located at his home.
When Officer Neal began reading the search warrant to him, he attempted to get the warrant from Neal and then ran down the hall inside the house. Boshears grabbed a .38 revolver and Neal began wrestling with him. When Officer Pogue came to assist, Boshears shot him once in the stomach. Boshears was taken into custody, but briefly escaped and began running from the officers. Boshears was shot in the leg and then beaten when he resisted the officers once they caught up with him.
Officer Pogue died the following day at the Bloomington Hospital.
