Officer Herbert was staged in response to a pursuit in progress after officers attempted to stop a stolen vehicle. The vehicle, being driven by a 15 year-old, crossed railroad tracks on a grade going 100 mph, went airborne, and struck Officer Herbert's car broadside. Officer Herbert died from his injuries.
The suspect fled on foot but was apprehended a short time later. He was charged with resisting law enforcement, sentenced in 2006 to 10 years in prison, and was paroled in 2009.
Officer Herbert had previously served with the Fortville Police Department. He had also served in the U.S. Army for 12 years.
